What is a conservation easement?
A conservation easement is a voluntary legal agreement between a land owner and a land trust or government agency that permanently limits the use of the land in order to protect its conservation values. This means that the land may only be developed/used by the terms of the easement. Every conservation easement is unique and allows different activities and developments. The purpose of an easement is to maintain the environmental integrity of the land for owners to enjoy, all the while sheltering natural habitats and providing an environmentally responsible homeplace. Foothills Land Conservancy states that “a conservation easement allows landowners to restrict development and prevent the degradation of their property’s valuable natural resources now and forever. People are connected to the land and the life it sustains, and Foothills Land Conservancy is proud to have many partners in land stewardship across the southeast. The conservation easement is a legal document that runs with the land; that is, the land stays protected forever, even after the landowner sells or conveys the property.” The original landowner drafts the document and reserves rights for their unique use of property while maintaining the land’s natural habitat, preservation of scenic space and agriculture.

Living on a conservation easement is a unique opportunity.
